Housing and residents associations, as well as private landlords of rented accommodation all have a duty of care under common and statute law to ensure that trees located on and around their properties are well maintained, to ensure that any reasonably foreseeable risk is reduced to an acceptable level.

  • Housing associations or private landlords would benefit from an arboricultural survey and report:

    • To establish what species of trees are growing at the property;

    • To identify any potential direct hazards that the trees may pose to the property and advise on best practice management recommendations to reduce any reasonably forseeable risk to an acceptable level;

    • To have in place a management programme to ensure the trees are managed correctly, monitored and inspected at regular intervals for safety reasons;

    • To ensure compliance with satutory legislation concerning tree ownership, such as The Occupier's Liability Act (1984).
